Background:
The Common Law contract provides the employer to negotiate a non-union employment agreement but it must meet or exceed all benefits available to the employee under the relevant Award or applicable industrial instruments.
A common law agreement gives the opportunity for an employer to declare and agree up front, various conditions of employment such as uniforms, motor vehicles, confidentiality and much more, that are not award matters, but are important to the business.
The employer might consider taking a 'No Disadvantage Test' approach to negotiations with this type of agreement.
