THREE TYPES: New Fulltime ITEA + Employee Collective + Common Law agreements.
Background:
From March
2008 the latest changes to Workplace Relations legislation took effect. The Government
stopped new AWAs but introduced new types of agreement:
Individual Transitional Employment Agreement
(ITEA) and Employee Collective Agreement,
both of which can be used by employers who want non-union contracts. Both types
must meet the new No Disadvantage Test
and be used with the Employee Information Statement
and then lodged using the Employers Declaration
Form (refer www.workplaceauthority.gov.au).
However,
an employer may still choose to negotiate an Individual Common Law agreement where
no other agreement exists and to
give protection in respect of certain employment
conditions such as wearing uniforms, use of motor vehicles, confidentiality and
much more. The COMMFORM Common Law agreement text makes available up to 40 of these
sort of conditions. Note, Common Law agreements must meet all the entitlements available
to the employee from the relevant Award and all other applicable industrial instruments,
so the same No Disadvantage Test approach
can be taken during negotiation for confidence in the outcome. They are not lodged.
